By accessing and using RizeTrade ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

RizeTrade provides a trading journal and analytics platform that allows users to:

• Track and analyze trading performance
• Import trade data from various sources
• Generate reports and insights
• Manage multiple trading accounts
• Journal trading activities and notes

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Payment

RizeTrade offers both free and paid subscription plans:

• Monthly subscriptions are billed on a recurring basis
• Lifetime subscriptions are one-time payments
• All payments are processed securely through Stripe
• Prices are subject to change with notice to existing subscribers
• Refunds are handled on a case-by-case basis within 14 days of purchase

5. Cancellation and Refunds

You may cancel your subscription at any time:

• Monthly subscriptions can be cancelled through your account settings
• Cancellations take effect at the end of the current billing period
• No partial refunds for unused time in a billing period
• Refund requests within 14 days will be reviewed individually
• Lifetime subscriptions are non-refundable after 14 days

6. User Content and Data

You retain all rights to the trading data and content you upload to RizeTrade. By using the Service, you grant us:

• The right to store and process your data to provide the Service
• The right to use anonymized, aggregated data for analytics and improvements
• The right to backup your data for disaster recovery

You are responsible for maintaining backups of your important data. We are not liable for any loss of data.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization
• Upload malicious code or viruses
• Violate any applicable laws or regulations

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by RizeTrade and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. RIZETRADE DOES NOT PROVIDE FINANCIAL, INVESTMENT, OR TRADING ADVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR TRADING DECISIONS.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy or completeness of any information provided through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIZETRADE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless RizeTrade and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Third-Party Services

The Service may integrate with third-party services (such as Stripe for payments, Polygon.io for market data). Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party services.

13. Modifications to Service

We reserve the right to modify or discontinue the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
